Acceptance of Terms

By downloading, installing, or using Vcar, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the app.

The Service

Vcar is a mobile app that lets you monitor and control compatible vehicles through the Smartcar API. Features include status monitoring, remote lock/unlock, location, diagnostics, charging management, and navigation. Availability and features depend on your vehicle's make, model, year, and region.

Eligibility & Accounts

• You must be at least 18 years old to use Vcar. • You must provide accurate account information and keep it up to date. • You are responsible for keeping your credentials and device secure. • One account per person; do not share your account.

Vehicle Authorization

You represent that you are the owner of, or an authorized user with permission to control, every vehicle you connect. Connecting to or controlling a vehicle without authorization is prohibited and may be unlawful.

Subscriptions & Payments

Some features require a paid subscription, sold on a per-vehicle basis. Subscriptions are billed through the app store (Apple App Store or Google Play) and managed by our subscription provider. Unless cancelled, subscriptions renew automatically at the end of each period. You can manage or turn off auto-renewal in your app store account settings. Except where required by law, payments are non-refundable, and app store refund policies apply.

Acceptable Use

You agree not to: • Use the service for any unlawful purpose. • Access or control vehicles you are not authorized to use. • Reverse engineer, decompile, or tamper with the app or our systems. • Interfere with or disrupt the service or its security. • Resell or commercially exploit the service without our permission.

Safety & Remote Commands

Never interact with the app while driving. Remote commands (such as lock/unlock or charging) may be delayed, fail, or behave differently across vehicles. Always confirm your vehicle's actual state before relying on it. You are responsible for the safe and lawful operation of your vehicle.

Third-Party Services

Vcar relies on third-party services, including Smartcar, your vehicle manufacturer, and the app stores. We do not control these services and are not responsible for their availability, accuracy, or actions. Your use of them may be subject to their own terms.

Intellectual Property

Vcar and its content, logos, and software are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the app for personal, non-commercial purposes.

Disclaimers

The service is provided 'as is' and 'as available', without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that vehicle data will always be accurate or timely.

Limitation of Liability

To the fullest extent permitted by law, Vcar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from vehicle operation, data inaccuracy, or service interruption. Nothing in these Terms limits liability that cannot be excluded under applicable law, including your mandatory consumer rights.

Indemnification

You agree to indemnify and hold Vcar harmless from claims, damages, and expenses arising from your misuse of the service, your violation of these Terms, or your violation of any law or third-party right.

Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the service or its users. You may stop using the app and delete your account at any time in Settings. On termination, your vehicle connections are disconnected and cached data is deleted, subject to our Privacy Policy.

Changes to the Terms

We may modify the service or these Terms from time to time. We will post the updated Terms in the app and revise the 'Last updated' date. Continued use after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of Türkiye, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Disputes will be handled by the competent courts, unless applicable law grants you the right to bring proceedings elsewhere.
